A New Jersey federal judge, on May 11, 2016, dismissed a proposed class action alleging Sanofi-Aventis US Inc. encouraged medical providers to bill for free drug samples and engaged in a kickback scheme to persuade retailers to sell its medication, but said it can be refiled with more specific allegations. Haefner, worked with lawyers from Cleary, Gottlieb, Steen & Hamilton, in successfully defending on appeal the lower court’s summary judgment in favor of Sanofi-Aventis U.S., LLC in Eisai, Inc. v. Sanofi Aventis U.S., LLC, No 14-2017 (May 4, 2016). The precedential decision, issued in May 2016, clarified the contours of Third Circuit antitrust law in regard to alleged market barriers created by contracting practices.
